Introduction

India's constitutional framework provides for special commissions to safeguard the interests of Scheduled Castes (SCs), Scheduled Tribes (STs), and Other Backward Classes (OBCs). These commissions function as constitutional and statutory bodies monitoring the implementation of safeguards, investigating violations, and advising on policy matters.

National Commission for Scheduled Castes (NCSC)

Constitutional Basis

• Article 338: Originally provided for a Special Officer for SCs and STs
• 89th Constitutional Amendment Act, 2003: Bifurcated the combined commission into NCSC and NCST
• Constitutional body - members appointed by the President

Composition

• Chairperson, Vice-Chairperson, and 3 other members
• Terms and conditions of service determined by the President
• Assisted by a Secretary and supporting staff

Functions

1. Investigate and monitor all matters relating to safeguards for SCs under the Constitution and laws
2. Inquire into specific complaints of deprivation of rights
3. Participate and advise on socio-economic development planning
4. Annual report to the President on working of safeguards
5. Make recommendations for effective implementation of measures
6. Civil court powers for summoning, discovery, evidence production
